Jump Bail
On December 10, 2005, Lex Adonis went on absence without official leave (AWOL) from his assignment in Bombo Radyo Cagayan de Oro. After due process, Bombo Radyos HRD dismissed him from employment for cause on February 10, 2006.
Forthwith, Bombo Radyo notified the court about the employment status of Adonis with Bombo Radyo. For failing to appear in subsequent hearings, the court declared Adonis to have violated the conditions of his bail posted for him by Bombo Radyo, forfeited the same, and ordered his immediate arrest.
In the case of Adonis co-accused Dan Vicente who was acquitted, the latter continued to attend court hearings. He was able to present evidence and testified for his defense. He continued to enjoy full management and support until the case was submitted for decision.
Basis of Conviction
The regional trial court said in its decision that former Bombo Gensan station manager Dan Vicente, in his testimony, was able to present evidence to prove his innocence. On the other hand, Adonis was convicted because the prosecution was able to overthrow the presumption of innocence. Adonis failed to rebut the prosecutions evidence because he was nowhere to be found as he already jumped bail.
How could he had possibly presented evidence for his defense when he was already in hiding even before the trial was over? His case could have possibly been decided the other way had Adonis not jumped bail but instead presented evidence for his defense.
No Basis to Blame Bombo
To recall, the President/CEO of Bombo Radyo Philippines, Dr. Rogelio M. Florete, DBM was, included in the original complaint. But after preliminary investigation, the prosecution dropped him from the charge sheet as it was shown that he had no direct hand whatsoever in the acts complained of.
The foregoing facts only disprove the allegation of Adonis that Bombo Radyo, his former employer, is partly to be blamed for his conviction. What is indubitable under the facts stated above is that he has only himself to blame for what has become of him at present.
