Then, Fernandez asked her if it was Jec-Jec or a certain Jeb who was her boyfriend. But she said she did not recognize any of those names.

“Ako na la’y uyaba, ayaw nang NPA (Better have me as your boyfriend, instead of NPAs,” Fernandez said, putting his hands around her hips.

When the girl asked for water, Fernandez pointed his private part and said, “Take my water instead. It may be white but it’s delicious.”

Fernandez saw that she was shaking and asked her if she felt cold. When she said yes, he reclined on the bed and said, “Come, lay beside me so we could keep warm.”

She also said Fernandez taunted her further by poking her butt with his feet.

“I was afraid that he might order his soldiers to shoot me if I would do anything that might provoke him,” she continued.

“I felt so tense, I was no longer aware I was already tossing my cell phone. It fell on the floor, where he took it, and said, “Go ahead, text the NPA. Tell them to kill me; just spare my troops.”

Fernandez did not return her cell phone.

She tried to divert him, by asking whether he had eaten breakfast. “We’ll have breakfast together. You will surely be satisfied. Your belly will bloat in nine months, and you will have a child as good-looking as I am.”

Then, Fernandez turned to the picture of a scantily clad young actress on a wall inside the hut and touched its private parts. “Do you know that you look like her?” he asked.

“You are the same because you have breasts and a vagina.”

It took almost an hour, before Fernandez released her, saying the next time he would call for her, she should make sure to wash herself up first.

She reported the incident to the village chief but the village chief told her not to pursue a case anymore because she does not have witnesses to prove her allegation in the first place.

The girl said she filed a complaint at the CHR in the hope that she would be given justice and that no more girls in the village her age would suffer as she did.

The girl also went to the office of Third District Councilor Myrna Dalodo-Ortiz, the acting mayor of Davao City, at the time. Ortiz said she advised the girl to seek a police blotter. The girl said she wanted to inform Mayor Rodrigo Duterte about her case.

In an interview over GMA Super Radyo, Lt. Fernandez denied the girl’s accusation, saying that the Alpha Company, which he leads, has been known for its good public relations.”

But he confirmed that he had brought the girl for questioning, because the girl was suspected of being an NPA informant in an encounter that killed a soldier. He also said his company follows strict procedures in the conduct of such investigations.

Lt. Fernandez also said that the girl was just being used by leftist groups “to discredit their work in the area.”

The military presence in Toril had been increased lately following recent clashes with NPA rebels believed to be still in the area.

Last Saturday (March 1), another encounter between the NPA and the military was reported in Toril. NPA rebels reportedly ambushed troops in Habanna, Barangay Catigan in Toril. The troops were on their way back to the detachment in Baracatan.
